  • Biden Says Call With Xi Was 'Robust,' But China Doesn't Seem Too Concerned

    As the country prepared to celebrate the Lunar New Year -- albeit, in a strictly limited, coronavirus fashion -- Chinese leader Xi Jinping had a phone call with US President Joe Biden, the first time the two men have spoken since the latter's election. Like many things in the post-Donald Trump era, the call was notable in large part for its normality, a return to how things were prior to 2016. According to a concise White House readout of the call, Biden "underscored his fundamental concerns about Beijing's coercive and unfair economic practices, crackdown in Hong Kong, human rights abuses in Xinjiang, and increasingly assertive actions in the region, including toward Taiwan." In briefing reporters, both before and after, US officials officials played up Biden's willingness to confront Xi and his long history of engaging with China, having met Xi himself several times when Biden was vice president to Barack Obama. The biggest difference that Trump presented to his predecessors was a willingness to blow up the US-China relationship entirely. To date, Biden's administration has been happy to retain most of Trump's tariffs and sanctions, as a negotiating tool if nothing else, and this week Biden ordered the Pentagon to review its China strategy, while continuing to send forces to the South China Sea. Of more potential concern to China, Biden has also suggested he could rally European leaders and other allies -- more willing to listen to him than Trump -- in opposing Beijing on various issues, though how this gels with also wanting Chinese engagement in other areas remains to be seen. In a call between Biden's Secretary of State Anthony Blinken and Chinese diplomat Yang Jiechi, the latter said "each side should focus on taking care of its own domestic affairs," adding that "no one can stop the great rejuvenation of the Chinese nation." Since Clinton, Washington has been criticized by China hawks for being too soft on Beijing, for not using the leverage it had while the two powers were unequal. Biden is perhaps the first US leader for whom this is not necessarily an option, and he will be dealing with a superpower that is on an equal footing.   • "You Win In Court Based On Strength Of Your Own Case Not On Weakness Of Opponent" -SC Reminds Mahama

    The Supreme Court has reminded the petitioner in the ongoing 2020 election petition, John Mahama that, a petitioner/plaintiff wins a case based on the strength of his own case and not based on the supposed weaknesses of his opponents’ case. This was contained in the ruling of the court to an application filed by John Mahama’s lawyers seeking to compel the EC Chairperson to necessarily mount the witness box and give evidence in support of the EC’s case. John Mahama, who had come to court purporting to challenge the validity of the election of President Akufo-Addo, told the court last Tuesday that he had closed his case after calling his 3rd/last witness to testify on his behalf. Counsel for the Respondents had however informed the court after the petitioner disclosed that he had closed his case, that, they (the Respondents) do not intend to lead further evidence in order to rebut the claims of the petitioner. They accordingly, prayed the court to give its final judgment on the petition based on the strength or otherwise of the petitioner’s case. This proposition, as the court ruled, was a clear aberration of the settled principle of law that the burden of proof in litigation lies on the plaintiff in a case and not on the defendant.     The Chief Executive Officer (CEO) of the Food and Drugs Authority (FDA), Delese Mimi Darko has held talks with the Cuban Ambassador to Ghana, His Excellency Pedro Luis Despaigne Gonzalez on the progress on the development of Cuba’s Covid-19 vaccine. It is recalled that on the 24th November 2020, the FDA and the Center for State Control of Drugs and Medical Devices (CECMED) of the Ministry of Public Health of the Republic of Cuba (MINSAP) signed a Memorandum of Understanding (MoU) to strengthen bilateral relations and cooperation in the area of health promotion.   • "We May Subpoena John Mahama If His Lawyers Subpoena Jean Mensa" – Kojo Oppong Nkrumah Hints

    Information Minister-designate and Member of the respondents’ legal team in the ongoing 2020 election petition hearing, Kojo Oppong Nkrumah has hinted that they may be compelled to subpoena former President John Dramani Mahama who happens to be the petitioner to the Supreme Court if his lawyers do the same to Electoral Commission chairperson Jean Mensa. ‘This is a court of law, not a court of public opinion’ – Oppong Nkrumah to Tsikata He said this while addressing a press conference outside the Supreme Court on Thursday, February 11, 2021. It follows the indication by the petitioner’s lawyers that they intend to reopen their case to enable them to subpoena the chairperson of the first respondent in the petition to the court to answer questions concerning the rejected election declaration. On Monday, February 8, 2021, the petitioner’s legal team closed its case after the respondents’ lawyers had cross-examined the former’s, three witnesses. The respondents’ lawyers then indicated to the court that they did not intend to call any witnesses, urging the court to proceed with the evidence before it. The respondents’ lawyers’ submission triggered a debate in court before the bench adjourned the hearing to the next day, Wednesday, February 9, 2021. When the hearing resumed the next day, the petitioner’s lead counsel spent hours trying to convince the court why it should compel the EC chairperson to be cross-examined, while the bench insisted that it would be a violation of her human right to force her to testify against her will. Mr. Tsikata argued that by the constitutional duty imposed on the Electoral Commissioner as a public servant, she is required to render an account to Ghanaians as to how she executed her constitutional duty of declaring who duly won the 2020 presidential election. He further argued that by the witness statement of the first respondent which its chairperson signed and, in several affidavits filed to the court in response to the petitioner’s refused application to serve interrogatories on her among others, she had indicated that she would be available to provide the answers being sought during cross-examination when she mounts the witness box.   • "Jean Mensa Can't Be Forced To Testify" - Supreme Court Rules

    The Supreme Court has in a unanimous decision ruled that the Chairperson of the Electoral Commission, Jean Mensa, and Peter Mac Manu cannot be forced to testify in the Election Petition case. The apex court made the ruling on Thursday, February 11, 2021, on the back of an application filed by lead counsel for the Electoral Commission, Justine Amenuvor, and that of President Akufo-Addo, Akoto Ampaw, asking for permission not to call any witness.
