FDA disagrees with High Court ruling in Tobinco Pharmaceuticals case, plans to appeal

The Food and Drugs Authority (FDA) has expressed its intent to appeal a recent High Court ruling in the case involving Tobinco Pharmaceuticals Ltd.


The FDA, in a statement signed by its Chief Executive Officer, Dr. Delese A. A. Darko, emphasized its disagreement with the court’s decision and reiterated its commitment to pursuing the matter further through the legal system.


Dr. Darko clarified that the case, which dates back to actions taken in 2013, was originally initiated during the tenure of the then-CEO, Dr. Stephen Opuni.

Despite media reports suggesting negligence on the part of the current FDA leadership, Dr. Darko assured the public that the Authority has consistently and vigorously defended itself in court since the action was initiated in 2019.


“The FDA acknowledges the judgement delivered by the High Court; however, we respectfully disagree with the decision and intend to exercise our right to appeal,” Dr. Darko stated.


She further emphasized the FDA’s commitment to upholding the rule of law and following due process until the matter is fully resolved.

The FDA’s leadership remains steadfast in its resolve to protect public health and safety while respecting the judicial process.
